Terms of Service

1. The service

ClipSmith ("the Service") is a private AI video production tool that helps you plan, generate, render, and publish short-form video content to third-party platforms you connect (YouTube, Facebook, Instagram, TikTok, X). By creating an account or connecting a platform you agree to these Terms.

2. Eligibility & account

You must be at least 18 years old and able to enter into a binding contract. You are responsible for keeping your login credentials secure and for all activity under your account.

3. Your content

You retain ownership of the scripts, prompts, images, voice-overs, and rendered videos you create with ClipSmith ("Your Content"). You grant us a limited license to store, process, render, and transmit Your Content solely to operate the Service on your behalf — including pushing it to the third-party platforms you explicitly connect.

4. Acceptable use

You agree not to use ClipSmith to:

• Generate or publish content that is illegal, defamatory, harassing, hateful, sexually explicit involving minors, or that infringes anyone's intellectual property or privacy rights.
• Produce disinformation, deepfakes of real people without consent, or content that impersonates others.
• Violate the terms of any connected third-party platform (YouTube, TikTok, Meta, X, etc.).
• Attempt to reverse engineer, overload, or abuse the Service or its underlying providers.

We may suspend or terminate accounts that violate these rules.

5. Third-party platforms

When you connect a platform (e.g. TikTok via Login Kit and the Content Posting API), you authorize ClipSmith to act on your behalf within the scopes you approve. Your use of each platform remains subject to that platform's own terms and community guidelines. We are not responsible for platform outages, policy changes, content takedowns, or account actions taken by those platforms.

6. AI-generated content

ClipSmith uses third-party AI models to generate text, imagery, and audio. AI output can be inaccurate, biased, or unintentionally similar to existing works. You are solely responsible for reviewing AI output before publishing it and for ensuring the final content complies with applicable laws, platform policies, and any required AI-content disclosures (for example, TikTok's AI-generated content label).

7. Fees

ClipSmith is currently operated privately. If paid plans are introduced, pricing and billing terms will be presented before you are charged.

8. Termination

You can stop using the Service and disconnect any platform at any time from the Network page. We may suspend or terminate access if you breach these Terms or if continued operation becomes impractical. On termination, your stored tokens and content may be deleted per our Privacy Policy.

9. Disclaimer & liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, ClipSmith and its operator are not liable for indirect, incidental, or consequential damages, or for any loss of revenue, data, or goodwill arising from your use of the Service. Total aggregate liability is limited to the amount you paid for the Service in the twelve months preceding the claim (or USD 100 if no fees were paid).

10. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes constitutes acceptance.
